CASE EXAMPLES
Resolution of Crane vs. Casing Jack Use for Tubular Removal in Offshore WellsThe federal Bureau of Safety and Environmental Enforcement (BSEE) was considering forbidding the use of cranes to remove tubing or casing from offshore wells. They were considering requiring casing jacks for all such work.
This would have slowed down the process and increased costs tremendously for the typical Gulf of Mexico rigless P&A process. I assembled a small team of industry experts and presented a one page table documenting existing best practices in the industry to BSEE. This educational meeting ended this effort by BSEE to increase regulation.
Valuation and Deal StructureEngagement was with a large industrial company whose business requires as large volumes of dry natural gas over many years as part of its processes. The client was considering purchase of natural gas reserves in the ground as a physical hedge against long term increases in the price of natural gas. Dan was engaged to help company evaluate alternatives ranging from purchasing royalty trust interests to working interests with producers. The physical location of the client’s facilities and regulatory considerations led to an evaluation of deals in the south central U.S, including the Arkoma Basin, Woodford shale, Barnett shale, Haynesville/Cotton Valley, and Tuscaloosa marine shale.
The engagement included a review of deal structure, reserves and production purchased, and pricing of transactions undertaken by other large natural gas end users; other transactions in the area of interest; examination of prospects on a field by field, producer by producer basis; consideration of new reserve demand arising from Gulf Coast LNG projects; and reserve volume price elasticity. The engagement resulted in a list of suitable target partners to be approached following management review.
Dan was able to call upon his deep experience and long relationships in the oil and gas industry to visit companies’ management, investment banking contacts, geologists, petroleum engineers, and industry regulators to develop an actionable plan for the client.
Economic Benefits to Offshore Hydrocarbon Production FacilityAccumyn’s expert provided deposition testimony on the economic benefits to the owners of an offshore production facility pursuant to the False Claims Act, 31 U.S.C. § 3729(a)(1) and to an incident of noncompliance determined by the Bureau of Ocean Energy Management, Regulation and Enforcement.
Accumyn’s team analyzed historical production of hydrocarbons reported to the government for royalty purposes; historical costs of lease payments, royalty production payments, and capital additions; annual volumes summarized by resource and reserve category; and the operator’s standardized measure of discounted future net cash flows relating to proven oil and gas reserves.
Damages Analysis for Crude by Rail DisputeRetained by a global leader in the energy and oil marketing and distribution industry, Mr. Tormo provided expert arbitration testimony regarding damages and the reasonableness of mitigation efforts in a breach of contract dispute involving the transportation of crude and ethanol by rail. Analysis involved determination of damages under Texas Uniform Commercial Code provisions, review and critique of opinions of defendant’s expert, evaluation of shale oil economics during the 2012-2015 timeframe, evaluation of crude by rail economics in the transport of Bakken crude to various U.S. Gulf Coast and East Coast storage and refining terminals, and examination of the alternative markets for rail tank cars in ethanol. Mr. Tormo submitted four expert reports, provided deposition testimony, and provided expert testimony at the arbitration hearing. Final arbitration award of $11 million was a clean sweep for client and provided for the exact damages calculated by Mr. Tormo.
